We have been in the mod wash cycle for 16 mth with chase. Hurricane ike hit us and we were told to add 2 payments to the end of our loan. Well that was not the wasy it worked. They then asked us to do a modification, all doc. were received and things were moving...sure they were. they offered us a temp payment for 2 months...all the while they added the differance to the balance and added late fee's as well( all for they offer). the help they offered us was 14 mth later of a second loan(not a modification) on top of the first one, with 5% interest for the next 15 years. So with all the fee's and everything else they told us to do we went from 3000. to 8850. and no one there will tell us why. Here's the kicker when we staed our income was reduced they not took the second loan off the table and said we will not qualify for a mod and foreclosure will stare now. Well, We have just been hit by a truck and will be on the street. the mod process is a CATCH 22, no one wins but the servicer. any one no of an attorney in texas? gina

I am soon to be a single mother. My husband is refusing to pay any support. I would love to keep my home for my 7 year old son (this is the only home he's known and does not want to leave). However, even though I have a master's degree, I am a counselor in a poor, rural Appalachian school district. I do not have the income to support my home and other debts. My mortgage is current, but as soon as the divorce is over, I won't be able to keep up with the payments. Please help. What can I do?

I am frustrated with Wells Fargo, we have both lost our jobs due to Chrysler down sizing, we wer'e 7 months behind last year and in forecloser, instead of lowering our intrest rate like the Obama plan stated, they just tacked on the amount we wer'e behind and brought us up to date, still not helping us out, but we wer'e pointed out that at least we wer'e still in our home!Yeah for how long!! I also had to send in 3 different sets of paper work and we are as of today back in modification again, it's not fair that they won't help homeowner's stay in their home ,but will sell it in a sell for no more than half it's worth! I have called and all I get is it's still in modification, no one will help you, where is the help Obama's plan said would be there?

Are Securitized Mortgages Subject to Usury Laws?

His argument is effectively the routes that allowed banks to evade state usury laws (a Supreme Court decision plus adept jurisdiction-shopping) may not extend to securitization trusts. And note this logic would apply to other types of securitizations, such as auto loans.

These aren’t mere academic questions. Securitization trusts hold around 60% of mortgage debt and 25% of other consumer debt. There’s no law directly on point, but if I’m correct, then usury could be raised as a viable defense to the collection of a sizable portion of consumer debt. And states would have pretty broad rein to regulate the collection of debts held by securitization trusts.
